General Terms & Conditions of UQBAH Funeral Assistance

Welcome to the UQBAH Funeral Service website, operated under LICARS Charity (Registered Charity No. 1057815). By using our website, you agree to comply with and be bound by the following terms and conditions. Please read them carefully before using this site.

1. General Information

  • This website is owned and operated by LICARS Charity, a registered UK charity (Registered No. 1057815).
  • The services described on this website are subject to availability and are provided in accordance with Islamic funeral principles.

2. Use of the Website

By accessing or using www.uqbahfuneral.co.uk, you agree to:

  • Use the website only for lawful purposes.
  • Not engage in activities that may harm, disrupt, or misuse the website or its contents.
  • Ensure that any information provided is accurate, complete, and up-to-date.

3. Participation Application

  • All UQBAH participation applications are to be assessed and authorised by the board.
  • All applicants are required to provide: Proof of identification, Proof of residence, Doctor's medical report.
  • Applicants with life-threatening illnesses are required to pay the maximum registration fee.
  • You are also required to pay the maximum registration fee if an eligible family participant suffers from a life-threatening illness (please see section 7 eligible family participants).
  • Completed paper application forms are to be posted to LICARS, 399 High Road, London, N17 6QN. All required documents must be submitted with the application form.
  • The board reserves the right to refuse an application at their discretion and they are not obliged to give an explanation for the refusal.

4. Participation and Signup

  • All Muslims over the age of 18 can be a participant.
  • Incapacitated persons including those who are handicapped require the approval of the board of UQBAH.
  • You must be permanently a resident in the UK.
  • You are required to pay a registration fee at the start of your participation to UQBAH as shown in section 5 below.

5. Registration Fees & Annual Fee

  • The annual fee is estimated by the board based on administrative costs and funeral expenditure from the previous year.
  • When the actual expenditure is calculated at the end of the year the balance is carried over to the following year's annual fee.
  • The annual fee is to be paid by standing order or bank transfer. Participants will have to bear any costs associated with these payment methods.
  • The annual fee is to be paid before 31st January for the respective year. Participation will be suspended and may be cancelled if the annual fee is not paid.
  • The suspension of participation does not eliminate the obligation to pay any annual fees in arrears.

6. Eligible Start of Participation

All successful applicants will be posted a welcome letter with their participant card within 30 days after we receive the completed application form with required documents.

7. Eligible Family Participants

  • The participant and the spouse.
  • Children under 18.
  • Severely handicapped children (50%) who are not earning (no age limit).
  • In the case of a divorce, the supported spouse can make their own separate application. The registration fee (section 5) is not applicable if the application is made within a year of the divorce. However, the annual fee amount for the respective year is payable.

8. Possible Scope of Support for Participants

  • All regulatory affairs. The board will decide whether support can be rendered as soon as the participant or the next of kin as per section 7 informs UQBAH in the case of death.
  • Preparing the deceased in accordance with Islamic custom and practice. The disposal of the deceased in accordance with the European standard.
  • Support in facilitating the outward and return journeys for an accompanying person if the funeral is to be abroad (economy class).
  • UQBAH will only bear the costs up to the designated airport for the deceased traveling to another country outside of Turkey and the Balkans.
  • Costs of up to £3500 will be covered for those who are being buried in the UK/EU/EEA or in Switzerland.
  • Participants who die outside the UK/EU/EEA or Switzerland can be transferred to and buried in the UK/EU/EEA or Switzerland provided the costs do not exceed £3000.
  • Costs up to £650 will be paid for those who die and are buried outside the UK/EU/EEA or Switzerland if the claim is submitted no later than six months after the death of the participant.
  • The funeral costs can only be supported in the UK/EU/EEA or in Switzerland for miscarriages (pregnancy loss) under 500 grams as per the meaning of the funeral act of that country.
  • Documents required: Passport, death certificate or death report, marriage certificate (internationally valid, otherwise in English translation), participant ID.
  • UQBAH will not be liable for costs arising as a result of the non-presentation of documents as listed.
  • UQBAH will not be liable for delays due to bank holidays or delays that are caused by the airlines or the contracted funeral directors.

9. Obligation to Notify

Every participant is required to truthfully, completely and accurately inform UQBAH about any changes to their personal details and those of their family participants. UQBAH will bear no responsibility for consequences arising from missing details/documents.

10. Claim for Support

The participants have no legal claim to support from UQBAH. All support of UQBAH is voluntary and requires a board resolution.

11. Termination of Participation

  • Participation ends via cancellation, exclusion or death.
  • Each participant can cancel the participation at the end of the calendar year. The cancellation must be in writing.
  • Participants can be excluded by the board if a gross infringement of the participant against Islamic principles is found to exist.
  • All rights and obligations of the participant lapse when participation ends. A refund of contributions paid is not applicable.

12. Other Provision

The board has the exclusive right to deal with discrepancies between the participants and administration of UQBAH.

13. Place of Jurisdiction

  • Disputes will be resolved in accordance with UK laws and the jurisdiction of UK courts.

14. Applicable Law

British law applies to the dealings between the participant and UQBAH funeral.

15. Power of Attorney for UQBAH

By accepting this agreement, all participants of the UQBAH Funeral authorize UQBAH Funeral to act on their behalf in matters related to the arrangement and execution of their funeral services. Upon becoming a participant of the system, participants grant UQBAH Funeral the right to make decisions and carry out official transactions as necessary. This includes but is not limited to, coordinating with relevant authorities, managing required documentation, and ensuring proper execution of the funeral arrangements in accordance with the agreement and participant preferences where applicable.

16. Intellectual Property Rights

  • All content on this website, including text, images, and design, is the property of LICARS Charity unless otherwise stated.
  • You may not reproduce, distribute, or otherwise use the content without prior written consent.

17. Links to Third-Party Websites

  • This website may contain links to external sites for your convenience.
  • UQBAH Funeral Service is not responsible for the content, accuracy, or privacy practices of third-party websites.

18. Limitation of Liability

  • LICARS Charity will not be held liable for any damages, losses, or claims arising from the use or inability to use this website or its services.
  • This includes but is not limited to technical issues, inaccuracies, or interruptions.

19. Data Protection

  • Your personal information will be handled in accordance with our Privacy Policy.
  • We do not share your data with third parties for marketing purposes.
